Our collection, use, and sharing of student information is governed by our contracts with the School and any applicable laws and regulations including, in the U.S., provisions of the Family Educational Rights and Privacy Act ("FERPA"), the Children's Online Privacy Protection Act ("COPPA") and applicable state laws. INFORMATION WE COLLECT FROM SCHOOLS AND VISITORS
Personal Information. We collect personal information from you that, directly or indirectly, identifies you such as your name, title, employer, address, telephone number, and email address (“personal information”). For example, we collect such personal information when you (i.e., School administrator) establish a user account on our Site.
Account Information. The account information we collect from you might include information regarding your School, your personal information and your student’s information, such as directory information, email addresses, student IDs, and account credentials. You are responsible for keeping your password secure.
School Administrator Information (such as the Teacher). We collect the School administrator’s information such as username, email address and title to initially set up Services as well as communicate with you when you need technical support.
Student Personal Information the District or School Collects. In order to provide you with our Services, we store the information you provide to us about your students so that you can administer the Services. We collect such student information you provide for the following reasons.
- We allow you to collect the name, email, and any other personal information from your students. Name and email are needed to allow students to access our Service to enroll, authenticate, or otherwise administer our course. This information you provide is given on a voluntary basis.
- You may collect additional information about your students in the course of administering your course. As a course administrator, it is your responsibility to ensure that information is being collected lawfully.
Financial Information. Depending on your needs as a customer, we may also collect your School’s financial information for payments to be made to Open Parachute. [Payment may be by credit card, debit card, checks, and/or third party online payment services. In such transactions, we will collect information related to the transaction as part of the course of doing business with you, including a billing address, telephone number, and other information related to the transaction.]
HOW WE USE PERSONAL INFORMATION
In General, How We Use Personal Information. Open Parachute will not use the personal information you provide to us for any purpose other than the purpose for which it was originally obtained without your prior consent. We use your personal information to communicate with you, to provide support regarding our Services. We may use your personal information and data to:
- Contact you via e-mail or by telephone regarding your order, your account status, your inquiries, and information about our Services.
- Resolve service disputes; troubleshoot problems.
- Respond to your requests and inquiries about our product and services.
- Send you marketing communications that we believe may be of interest to you; Student personal information will not be used for targeted advertising by Open Parachute.
- Personalize your experience on the Site by presenting products and offers tailored to you.
- Provide you with system or administrative messages.
- To learn more about how we use your information, please consult with the School.
- As a data processor, Open Parachute provides learning and registration Services on behalf of the School.
- The specific information that is collected from the School depends upon the Open Parachute Service, but in general, this information includes personal information such as: name, email address, student ID, account credentials, and additional records as requested by the School.
- Open Parachute will only use student data for the purposes of providing the Services that our customers have contracted with us to provide.
HOW WE SHARE INFORMATION WITH OTHERS
We do not rent, sell, or share your personal information about you with other people or nonaffiliated companies for their direct marketing purposes. We use third party service providers to perform functions or services on our behalf. When we transfer your information, we require all our service providers to maintain the privacy, confidentiality and security of the personal information and data. We take steps to ensure that these parties take protecting your privacy as seriously as we do. Within Open Parachute, your information will be accessed only by those who have a need to provide the Open Parachute Services.
Types of Service Providers. We engage third parties to perform services on our behalf such as software maintenance services, hosting services, email service providers, database management, web analytics, and other services.
[Marketing Support Services. Like many companies, we contract with third parties to provide customer relationship management (“CRM”) tools for marketing purposes. Typically, these CRM tools are available for our use through a cloud-based platform. We engage third parties to provide CRM tools that compile customer personal information and data that may be collected through various channels, such as through the through the Sites, telephone, direct mail, marketing materials.]
Student Information We Share. We share student information in accordance with our agreement with School. Generally, this includes the sharing of such information inside and outside Open Parachute under certain terms. Student information will be accessed inside Open Parachute only by those have a need to know to provide the Open Parachute Services and improve them. For example, our technical and client support teams may have access to personal information when the Open Parachute Services are implemented for your School or when software or other changes are required for support and maintenance purposes. We use vendors to help us on our behalf to provide the Open Parachute Services to you (or to your students).
YOUR RIGHTS CHOICES
Right to Review and Rectify Your Personal Information. You may access your account at any time to correct, update, or delete inaccuracies by logging into your account through our Site. If additional assistance is required to change or delete inaccuracies within your personal information or you would like to know what information about you was collected, please contact us at firstname.lastname@example.org or (424) 248-5680. We reserve the right to charge for copies of data requested.
Right to Remove or Withdraw Consent. You have the right to withdraw consent where such consent is required to share or use data by emailing email@example.com. The School is responsible for maintaining current student rosters and identifying student information which the School no longer needs for an educational purpose by removing students from the School's master roster or by submitting a request to delete account or student information. You may delete your personal information by emailing firstname.lastname@example.org and requesting your account be deleted. Deleting a student account is permanent and irreversible. You will not be able to restore your account progress/details if it was deleted by accident. If you receive communications from us and no longer wish to receive them, please follow the opt out or removal instructions in the email. Since your personal information is required for us to provide you Services, keep in mind that deleting your information will also terminate your access to our Services. We may be required by law, to retain it to exercise or defend legal claims, or contractual obligations with our customers to retain some information in connection with our obligation to provide the Services. We may de-identify and anonymize some data for purposes of retaining it.
Data Portability. If you would like us to transmit your personal information to another company providing similar services and we are required to so by law, we will work with them to do so upon request and verification of such request with both the requestor and the company receiving the personal information.
Communication. We will provide you reasonable mechanisms to exercise your choice regarding receipt of information from Open Parachute. When you receive an email from us, you may opt-out from receiving future emails from Open Parachute by clicking on the unsubscribe link contained in the e-mail, by writing to us at the address provided in the email, by contacting us at email@example.com or by telephone at (424) 248-5680.
DATA STORAGE AND RETENTION
Your personal information is stored by Open Parachute on its servers, and on the servers of the cloud-based database management services Open Parachute engages, located in the United States and Canada. We will retain and use your personal information for as long as your account is active, as needed to provide you Services, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

The security of your personal information is important to us. To help protect privacy and personal information you transmit through use of our Sites, we maintain physical, technical and administrative safeguards. We take reasonable and appropriate measures to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction by taking into due account the risks involved in the processing and the nature of the personal data. For example, we encrypt your credit card number when you provide such information to us for processing your orders.
CHILDREN UNDER THE AGE OF 13
Since our Service is used by a School in an educational setting, the School authorizes us to collect information from a child under 13.

PROTECTION OF STUDENT INFORMATION AND COMPLIANCE WITH LAWS
The collection, use and disclosure of student data is governed by our Terms of Service and/or any other agreement with the School, by the provisions of the Family Educational Rights and Privacy Act ("FERPA"), the Children's Online Privacy Protection Act ("COPPA") and other applicable laws that may relate to the collection and use of personal information of students.

- Open Parachute does not collect, maintain, use or share student data beyond that needed for an authorized educational or School purpose, or as authorized by our agreement with a School.
- We do not use or disclose student information for targeted advertising purposes.
- Open Parachute does not build a personal profile of a student other than in furtherance of a K-12 School purpose, or as authorized by the School.
- We will not knowingly retain student information beyond the time period required to support the School's purpose, unless authorized by the parent.
- We will never sell student data unless the sale is part of a corporate transaction, such as a merger, acquisition, bankruptcy, or other sale of assets, in which case we will use our best efforts to ensure the successor entity honors the privacy commitments made in this policy and/or we will notify the School of such a sale and provide the School an opportunity to opt-out by terminating its account before the data transfer occurs.

This Site contains links to websites of other organizations. Open Parachute will use your personal information only for the purposes for which it was collected, unless you provide prior consent. We will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.
If you provide personal information to us directly, we may transmit your data, including all your personal information, to Canada or the United States, in order to fulfill our contractual obligations to you.
