For purposes of this Privacy Policy, the School determines what information we collect through the Open Parachute Services and how such information is used, and we process the student information according to the School’s instructions and the terms of our contract with your district or School. This Service may be purchased by providers of educational services, such as schools, school districts, or government  education department (collectively referred to as "Schools") that use our Services for educational purposes.

Open Parachute is a data processor (“data processor”) with respect to student or parent personal information, and the School is the data controller (“data controller”). The School acknowledges and agrees that Open Parachute is a data processor with respect to personal information received from that School, student or parent in connection with Open Parachute Services. Therefore, it is the responsibility of the School to provide a privacy policy that complies with the laws applicable to its users. This Privacy Policy is broken down into different sections for you to understand the terms that are applicable to you.

Our collection, use, and sharing of student information is governed by our contracts with the School and any applicable laws and regulations including, in the U.S., provisions of the Family Educational Rights and Privacy Act ("FERPA"), the Children's Online Privacy Protection Act ("COPPA") and applicable state laws. For more information regarding protection of student information, see section titled “PROTECTION OF STUDENT INFROMATION AND COMPLIANCE WITH THE LAWS”.


Personal Information. We collect personal information from you that, directly or indirectly, identifies you such as your name, title, employer, address, telephone number, and email address (“personal information”). For example, we collect such personal information when you (i.e., School administrator) establish a user account on our Site.

Account Information. The account information we collect from you might include information regarding your School, your personal information and your student’s information, such as directory information, email addresses, student IDs, and account credentials. You are responsible for keeping your password secure.

School Administrator Information (such as the Teacher). We collect the School administrator’s information such as username, email address and title to initially set up Services as well as communicate with you when you need technical support.

Student Personal Information the District or School Collects. In order to provide you with our Services, we store the information you provide to us about your students so that you can administer the Services. We collect such student information you provide for the following reasons.

Financial Information. Depending on your needs as a customer, we may also collect your School’s financial information for payments to be made to Open Parachute. [Payment may be by credit card, debit card, checks, and/or third party online payment services. In such transactions, we will collect information related to the transaction as part of the course of doing business with you, including a billing address, telephone number, and other information related to the transaction.]

Automated Information; Cookies. As is true of most other websites, the Open Parachute Site collects certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of our Site, including a history of the pages you view. When you visit our Site, we may send one or more cookies to your device. They enable us to store information about your device which helps us, amongst other things, to provide you with a good experience when you browse our Site and enhance the level of services and functions provided. In General, How We Use Personal Information. Open Parachute will not use the personal information you provide to us for any purpose other than the purpose for which it was originally obtained without your prior consent. We use your personal information to communicate with you, to provide support regarding our Services. We may use your personal information and data to:

How We Use Student Information. As your School’s data processor, we use your information on behalf of and under the instruction of the student’s School. We use student information in accordance with our agreement with the student’s School to operate, maintain, and provide the features and functionality of the Open Parachute Services.


We do not rent, sell, or share your personal information about you with other people or nonaffiliated companies for their direct marketing purposes. We use third party service providers to perform functions or services on our behalf. When we transfer your information, we require all our service providers to maintain the privacy, confidentiality and security of the personal information and data. We take steps to ensure that these parties take protecting your privacy as seriously as we do. Within Open Parachute, your information will be accessed only by those who have a need to provide the Open Parachute Services.

Types of Service Providers. We engage third parties to perform services on our behalf such as software maintenance services, hosting services, email service providers, database management, web analytics, and other services.

[Marketing Support Services. Like many companies, we contract with third parties to provide customer relationship management (“CRM”) tools for marketing purposes. Typically, these CRM tools are available for our use through a cloud-based platform. We engage third parties to provide CRM tools that compile customer personal information and data that may be collected through various channels, such as through the through the Sites, telephone, direct mail, marketing materials.]

Law Enforcement and Internal Operations. Personal information may be provided where we are required to do so by law, or if we believe in good faith that it is reasonably necessary (i) to respond to claims asserted against Open Parachute or to comply with the legal process (for example, discovery requests, subpoenas or warrants); (ii) to enforce or administer our policies and agreements with users; (iii) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes; or (iv) to protect the rights, property or safety of Open Parachute, its users or members of the general public. We will use commercially reasonable efforts to notify users about law enforcement or court ordered requests for data unless otherwise prohibited by law. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to any third-party request to compel disclosure of your information.

Affiliates and Business Transfer. We may share your personal information with our parent, subsidiaries and affiliates. Open Parachute may also sell, transfer or otherwise share some or all of its assets, including your personal information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.  Under such circumstances, Open Parachute will use commercially reasonable efforts to notify its users if their personal information is to be disclosed or transferred and/or becomes subject to a different privacy policy.

Student Information We Share. We share student information in accordance with our agreement with School. Generally, this includes the sharing of such information inside and outside Open Parachute under certain terms. Student information will be accessed inside Open Parachute only by those have a need to know to provide the Open Parachute Services and improve them. For example, our technical and client support teams may have access to personal information when the Open Parachute Services are implemented for your School or when software or other changes are required for support and maintenance purposes. We use vendors to help us on our behalf to provide the Open Parachute Services to you (or to your students).


Right to Review and Rectify Your Personal Information. You may access your account at any time to correct, update, or delete inaccuracies by logging into your account through our Site. If additional assistance is required to change or delete inaccuracies within your personal information or you would like to know what information about you was collected, please contact us at or (424) 248-5680. We reserve the right to charge for copies of data requested.

Right to Remove or Withdraw Consent. You have the right to withdraw consent where such consent is required to share or use data by emailing The School is responsible for maintaining current student rosters and identifying student information which the School no longer needs for an educational purpose by removing students from the School's master roster or by submitting a request to delete account or student information. You may delete your personal information by emailing and requesting your account be deleted. Deleting a student account is permanent and irreversible. You will not be able to restore your account progress/details if it was deleted by accident. If you receive communications from us and no longer wish to receive them, please follow the opt out or removal instructions in the email. Since your personal information is required for us to provide you Services, keep in mind that deleting your information will also terminate your access to our Services. We may be required by law, to retain it to exercise or defend legal claims, or contractual obligations with our customers to retain some information in connection with our obligation to provide the Services. We may de-identify and anonymize some data for purposes of retaining it.

Data Portability. If you would like us to transmit your personal information to another company providing similar services and we are required to so by law, we will work with them to do so upon request and verification of such request with both the requestor and the company receiving the personal information.

Communication. We will provide you reasonable mechanisms to exercise your choice regarding receipt of information from Open Parachute. When you receive an email from us, you may opt-out from receiving future emails from Open Parachute by clicking on the unsubscribe link contained in the e-mail, by writing to us at the address provided in the email, by contacting us at or by telephone at (424) 248-5680.


Your personal information is stored by Open Parachute on its servers, and on the servers of the cloud-based database management services Open Parachute engages, located in the United States and Canada. We will retain and use your personal information for as long as your account is active, as needed to provide you Services, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

The security of your personal information is important to us. To help protect privacy and personal information you transmit through use of our Sites, we maintain physical, technical and administrative safeguards. We take reasonable and appropriate measures to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction by taking into due account the risks involved in the processing and the nature of the personal data. For example, we encrypt your credit card number when you provide such information to us for processing your orders.

We restrict access to your personal information to those employees and authorized consultants and contractors who need to know that information to provide benefits or Services to you. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your information. Any employee that Open Parachute determines is in violation of this Privacy Policy will be subject to disciplinary action. Open Parachute will conduct compliance audits of its relevant privacy practices to verify adherence to this Privacy Policy. However, because no security system can be 100% effective, we cannot completely guarantee the security of any information we store, process or transmit.


Open Parachute does not permit children under the age of 13 to create an account and does not knowingly collect personally identifying information from children under the age of 13 without the consent and at the direction of a parent. Since our Service is used by a School in an educational setting, the School authorizes us to collect information from a child under 13.

The collection, use and disclosure of student data is governed by our Terms of Service and/or any other agreement with the School, by the provisions of the Family Educational Rights and Privacy Act ("FERPA"), the Children's Online Privacy Protection Act ("COPPA") and other applicable laws that may relate to the collection and use of personal information of students.

The Family Educational Rights and Privacy Act ("FERPA"). This Privacy Policy and our Service are designed to meet our responsibilities to protect personal information from the students' educational records under FERPA. We agree to work with each School to jointly ensure compliance with the FERPA regulations.

The Children's Online Privacy Protection Act ("COPPA"). This Privacy Policy and our Service are designed to comply with COPPA. We do not knowingly collect personal information from a child under 13 unless and until a School has authorized us to collect such information through the provision of the Service on the School's behalf. When a School uses our Service in the classroom or in an educational context, we rely on the School to provide appropriate consent and authorization for a student under 13 to use the Service and for Open Parachute to collect personal information from such student, as permitted by COPPA. Upon request, we will provide the School the opportunity to review and delete the personal information collected from their students. If you are a parent and you have questions about your child's use of our Service and any information collected, you should discuss your questions with your child's School.

Students Online Personal Information Protection Act ("SOPIPA"). This Privacy Policy and our Service are designed to comply with SOPIPA. We do not use student data for targeted advertising purposes. We do not use collected information to amass a profile of a K-12 student except in furtherance of K-12 school purposes. We never sell student data unless the sale is part of a corporate transaction, such as a merger, acquisition, bankruptcy, or other sale of assets, in which case we make efforts to ensure the successor entity honors the privacy commitments made in this policy and/or we will notify you of such a sale and provide you an opportunity to opt-out by deleting your account before the data transfer occurs. We will not sell students' personal information to third parties other than in the context of a business transaction.
